Introduction

These terms and conditions are entered into by and between James Holland T/A Overtime Fitness (hereinafter: “Overtime Fitness”) and you (hereinafter: “The Member”).

Please take the time to read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the website. If you do not agree to be bound by these terms and conditions, you should stop using the website immediately.


Signing Up

The Member must ensure that the details provided upon sign up or at any time are correct and complete.

The Member must inform Overtime Fitness immediately of any changes to the information provided when signing up, by updating any personal details. This ensures that Overtime Fitness can communicate with The Member effectively.

Overtime Fitness may cancel The Member’s subscription with immediate effect for any reasonable purposes, or if these terms and conditions are breached.

The monthly subscription can be cancelled at any time, and the same applies to the three-month package following the initial three-month payment. The Member can cancel directly via PayPal or Overtime Fitness can cancel it, at The Member’s request. Once cancelled, The Member will not be charged again and will be able to continue the service and access the app until the end of the current payment period.


Medical

Overtime Fitness are not medical practitioners or registered dieticians. It is strongly recommend and we advise any potential client, that prior to commencing any diet or exercise regime that they should consult a medical practitioner and/or registered dietitian first.

Any nutritional recommendations made will be considered advisory and not prescribed. In no instance will Overtime Fitness attempt to diagnose, examine, or treat medical conditions of any kind. 

PAR-Q and Informed Consent Forms will be completed prior to commencing any form of physical activity. Should The Member be suffering from a current injury or previous injury which has not healed, then Overtime Fitness reserve the right to refuse entry onto their services. Failure to disclose this information prior to commencing any programme will mean immediate termination of The Member’s subscription. Should this occur, The Member will not receive a refund of their payment. 

The Member must also answer all screening questions regarding training age, ability and skill levels truthfully prior to commencing any form of exercise. Failure to disclose this information, or failure to answer truthfully prior to commencing any programme, will mean immediate termination of The Member’s subscription. Should this occur, The Member will not receive a refund of their payment.


Waiver of Liability

The Member acknowledges that when participating in any exercise program that there is the possibility of physical injury. All programmes will be bespoke to each individual based on the The Member’s training age, ability & skill level in order to maximise results and to minimise the risk of potential injury.

The Member accepts the risk that potential injury may occur whilst undertaking any form of exercise prescribed and will not hold Overtime Fitness responsible. 


Prohibited use

All programmes are to be viewed by The Member and The Member alone. Anyone found to be sharing or supplying a training programme with a person who is not a client or member of Overtime Fitness will have their subscription immediately terminated. 

The Member must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any content without the written permission from Overtime Fitness.

The content of the website, overtimefitness.co.uk, and all social media platforms associated remain that of Overtime Fitness and cannot be reproduced, modified, copied, distributed or used for commercial purposes without the written permission of Overtime Fitness. Anyone found to do so will face legal action.


Insurance

Overtime fitness is insured through Insure4Sport for public liability and professional indemnity.


Age Limit

The Member confirms that he/she is 18 years old or older. For persons 16 or 17 years old, exceptions are granted based on a written parental consent and a consultation through a Zoom chat will also be required.


Refund Policy

Overtime Fitness does not offer any refunds, as this is a custom made subscription product. The Member does have the right to cancel future subscriptions at any point via PayPal or by emailing Overtime Fitness.


Price Changes

Overtime Fitness reserves the right to increase the price of its services. Every Member will be notified 30 days in advance about any price increase. 

The 12 Peak Challenge price is set at the start, no price increase will be made throughout for any Member paying direct debit. Overtime Fitness reserves the right to then increase the price of future 12 Peak Challenges. 


Renewal & Cancellations

Each Member agrees to a monthly subscription service when signing up. Our Online Coaching service will be a continuous subscription where The Member can opt out and cancel future payment at any time during that month. Once payment is made The Member will have full access to their training programme via the Truecoach app for the month ahead.

Cancellations can be made via email, communicating through the Truecoach App or by contacting the coach directly via phone.

The 12 Peak Challenge is a set 12 week programme, which when a Member signs up, agrees to completing the 12 weeks and in turn completing the full payment. There are two options:

1: Payment in full – Full payment made upfront prior to the commencement of the programme.

2: Monthly direct debit – Option to pay monthly, initial payment made on day 1, followed by payment on day 30 & day 60.
Failure to complete payment when due via this option will result in immediate termination of your membership and your place on the challenge will be removed. 

Numbers will be capped on this programme and the intakes will be decided on an application basis. As a result, no cancellations will be accepted or refunds applied once the programme has begun.

The Member has the option to cancel and obtain a full refund of any payment made, provided there is 72 hours or more left to commencement of the Challenge.


Payment

The Member agrees to make all payments on time, any late payment will mean training programmes become suspended. The Member will be granted a 3 day grace to make the payment to remain a Member of Overtime Fitness. After 72 hours, the subscription will be cancelled and they will no longer be a Member of Overtime Fitness.
